Nintendo sues US over Trump tariffs after Supreme Court ruling

Nintendo of America has filed a lawsuit against the US government, including the Treasury Department and Customs and Border Protection, over Trump-era tariffs. The video game company claims it has been substantially harmed by the unlawful execution of executive orders and is seeking a refund with interest for tariffs already paid. This legal action follows a Supreme Court ruling that confirmed the Trump administration's global tariffs were implemented illegally.

In August 2025, Nintendo raised prices on the original Nintendo Switch due to "market conditions" but has not yet increased prices for the newer Switch 2 console. The company's lawsuit, filed in the Court of International Trade, cites the February Supreme Court decision that upheld lower court opinions against the administration's use of the International Emergency Economic Powers Act to impose tariffs. While Congress holds authority over trade policy, President Trump used executive orders to implement a collection of global tariffs during his first year in office.

Other companies have also filed lawsuits seeking tariff refunds, and US Customs and Border Protection is reportedly preparing systems to process these claims. However, Trump has announced plans to introduce new tariffs using alternative methods. Nintendo faces additional challenges beyond tariffs, including a potential price increase for its consoles due to a RAM shortage driven by the AI industry.
