Nintendo sues over tariff refunds amid gamer backlash fears

Nintendo has joined thousands of companies suing the Trump administration to secure full refunds for billions in unlawful tariffs collected under the International Emergency Economic Powers Act. The gaming giant fears the administration may try to avoid paying refunds to companies whose tariff payments have already been liquidated, leaving many uncertain if they can recover their payments.

In its complaint, Nintendo argues that without court intervention to order reliquidation of all tariff entries, the company will suffer "imminent irreparable harm." The company claims the Trump administration has no plans to oppose such an order and is simply waiting for the court to mandate refunds for all affected importers.

Notably absent from Nintendo's complaint was the amount of tariffs the company seeks to recover. The company declined to share estimates, likely due to potential backlash from gamers who may demand Nintendo share any refunds. This comes after Nintendo faced criticism for both ordinary and tariff-related price increases, including the Switch 2's $450 price tag that sparked online protests demanding price drops.
