Lancaster Country Day School (LCDS) is seeking to dismiss a lawsuit filed by victims of AI-generated nudes, arguing the school remained silent for months while boys allegedly targeted classmates. The private K-12 school claims it was false to say they never reported harm, as the tip came from the Pennsylvania Office of the Attorney General, a law enforcement agency. LCDS also disputes knowing girls were targeted, stating the tip lacked specific victims and was too vague.

LCDS asserts they investigated the tip "as best as their educator training allowed" but only identified one "bad actor." They maintain all activity occurred off-campus and that AI images do not qualify as child abuse under current state law, thus negating a mandatory reporting duty. The school interviewed the accused boy and his mother, who provided no further information. The boy has since pled guilty along with another student to 59 felony counts of sexual abuse of children.

Victims' lawyers argue LCDS exhibited "institutional failure," with an assistant head of Upper School allegedly dismissing concerns by saying, "boys will be boys." They claim the school hindered investigations and discouraged reporting to police, while also being "deliberately indifferent" to severe sexual harassment. Gaps in Pennsylvania law, which do not explicitly define AI-generated CSAM as child abuse, may allow the school to avoid liability, though lawmakers are pushing to close such loopholes.
