DOJ Defends Kennedy's Vaccine Authority as 'Unreviewable'

A Department of Justice lawyer argued that Robert F. Kennedy Jr. has sweeping authority over federal vaccine policy, claiming his actions are 'unreviewable' by courts. During a Boston hearing, US District Judge Brian Murphy expressed skepticism about this position, questioning whether Kennedy could mandate giving people measles instead of preventing it.

Murphy's pointed questions came as medical organizations sought to block Kennedy's vaccine policy changes through an injunction. The groups argued that Kennedy's modifications bypassed standard procedures and lacked scientific backing. Isaac Belfer, representing the Department of Health and Human Services, countered that the medical groups were attempting to use courts to enforce their preferred vaccine policies.

The judge indicated he would rule before a March 18 CDC vaccine advisors meeting, calling it a 'hard deadline.' Kennedy's critics say his changes represent the 'actions of someone who believes he can do whatever he wants,' while the DOJ maintains he has broad discretion over vaccine policy decisions.
