Apple Opposes OpenAI Dismissal in Trade Secret Suit

Apple has filed a new legal brief opposing OpenAI's motion to dismiss a trade secret theft lawsuit, arguing the company's dismissal attempt relied on distortion, speculation, and improper evidence. The dispute stems from allegations that OpenAI employees improperly accessed Apple's confidential data.

Apple claims that defendant Liu did not accidentally obtain data from Apple's servers but instead exploited a known bug and bragged about it, allegedly saying "LOL ... so funny." The company also alleges that interviews with Apple employees included coaching on how to extract sensitive information, and that defendant Tan specifically requested secret prototypes rather than publicly available products.

In its filing, Apple states that OpenAI repeatedly misappropriated trade secrets through the actions of defendants Liu and Tan, as well as through its own independent conduct. Apple is requesting that the court deny OpenAI's motion for dismissal and allow expedited discovery to proceed.

The case is set to resume on October 1, where Apple's request for expedited discovery will be heard. Apple initially sued OpenAI earlier this year, with the lawsuit centered on allegations of improper acquisition and use of proprietary information related to Apple's artificial intelligence development efforts.
