Perplexity has successfully overturned an injunction that banned its AI shopping tool, integrated into its Comet browser, from accessing Amazon. The Ninth Circuit Court of Appeals ruled that Amazon's claim of Perplexity violating the Computer Fraud and Abuse Act (CFAA) was not strong enough to warrant the injunction.

The court determined that since the Comet browser requires user direction to access Amazon, it was the user, not Perplexity, who was accessing Amazon's servers. Therefore, the violation of the CFAA, which requires intent and demonstrable loss, was not proven. The appeals court stated that an injunction against conduct that likely doesn't violate the CFAA would not serve the public interest.

Amazon had initially sent Perplexity a cease-and-desist letter in November 2025, alleging a breach of an earlier agreement regarding AI shopping bots. Amazon then filed a lawsuit in March 2026, leading to the temporary injunction. While this appeal decision removes the injunction, the lawsuit is ongoing, and Amazon is considering its next steps, including potential rehearings or Supreme Court review.
