DOJ backs xAI in battle over Colorado AI law

Elon Musk’s AI startup xAI has entered court with the U.S. Department of Justice backing its challenge to Colorado’s new AI law. The suit, filed in early April, targets Colorado Bill SB24‑205, which bars developers of high‑risk systems from ignoring algorithmic bias. The DOJ now asks a federal judge to strike the law as unconstitutional.

SB24‑205 requires disclosures and mitigation plans for tools used in healthcare, employment or housing. The rule takes effect in June, but xAI argues it forces developers to reshape products to fit Colorado’s diversity standards, violating First Amendment freedoms and, per the DOJ, the Equal Protection Clause of the Fourteenth Amendment and undermine the market.
