Spain Bans Polymarket and Kalshi Over Gambling License Concerns

Spain has blocked access to prediction market platforms Polymarket and Kalshi while authorities investigate whether these services violate the country's gambling laws. The Ministry of Consumer Affairs ordered the precautionary measure because neither platform holds the required gambling licenses to operate in Spain. This investigation, expected to conclude within four months, could force these companies to obtain specific administrative licenses if regulators determine they're operating illegally.

The move mirrors actions by several US states, though the federal government has pushed back. Minnesota recently became the first state to ban prediction markets outright, making it a felony to operate or advertise them. Meanwhile, the US Commodity Futures Trading Commission has sued states attempting regulation, claiming exclusive federal jurisdiction over these platforms. This creates a direct conflict between state and federal authorities over who controls prediction market oversight.

Recent controversies highlight why regulators are concerned. A US soldier allegedly used classified information about Venezuela's Nicolas Maduro to win over $400,000 on these platforms. Another individual reportedly rigged weather predictions by pointing a hairdryer at sensors, pocketing $34,000 twice. These incidents demonstrate how prediction markets can be manipulated when bets tie to real-world events lacking proper oversight.

Despite regulatory challenges, both platforms maintain substantial valuations. Kalshi was recently valued at $22 billion while Polymarket reached $15 billion, reflecting strong investor confidence in prediction markets as a financial product category that traditional regulators are still struggling to understand.
