An Oregon woman identified as Jane Doe has filed a lawsuit against Apple in the U.S. District Court for the District of Oregon in Medford, alleging that Apple's anti-stalking safeguards failed to warn her when her former partner used an AirTag to track her. The victim claims she was tracked on multiple occasions after the AirTag was placed under her vehicle, resulting in verbal and written threats, property damage, and eventual criminal charges against the stalker. Despite owning an iPhone, she says she received no notification from Apple about the unknown AirTag traveling with her.

The suit accuses Apple of negligence, citing the failure of its prolonged presence alert system, which is designed to notify users when an AirTag is moving with them without the owner nearby. Apple has implemented multiple safeguards since 2024, including cross-platform alerts with Android and firmware updates to make AirTags easier to detect.
