Everton have lodged an appeal against a Premier League Independent Disciplinary Commission ruling that orders the club to pay £35m to Burnley as compensation for Profit and Sustainability Rules breaches in June 2022. The Toffees argue the decision is legally flawed and misrepresents evidence presented by their lawyers. A club statement described the order as “dangerous and unworkable” for English football.

The dispute stems from Everton’s 2021‑22 season, when they finished four points above the relegated Burnley. A six‑point penalty for PSR breaches, applied retroactively, would have dropped Everton below the Clarets, altering the final table. Everton were originally docked ten points in late 2023, reduced to six on appeal under Farhad Moshiri’s ownership for the club.

Everton’s compensation bill breaks down into £26m principal plus £9.1m interest, far significantly short of the £51.7m Burnley originally sought. The club maintains it was unaware of the breach until months after Burnley’s relegation, arguing six weeks remained to correct accounts. The appeal will test whether financial rule breaches can trigger direct payouts, a precedent that could affect future club disputes in English.
