Apple Petitions Supreme Court on App Store Fee Ruling

Apple has formally asked the U.S. Supreme Court to review a contempt ruling that barred it from charging fees on App Store link-outs to third-party payment options. This follows a 2021 injunction from Judge Yvonne Gonzalez Rogers, who ordered Apple to allow such links but Apple imposed a 12 to 27 percent fee instead of its standard rate.

Epic Games sued for contempt, and in April 2025 Rogers barred all fees on links. The Ninth Circuit upheld contempt but permitted reasonable fees for Apple's intellectual property. Apple argues the injunction didn't clearly prohibit fees, making the contempt finding improper under a vague "spirit-based" standard that risks judicial overreach.

Apple also contends the universal injunction affecting all developers exceeds the case scope, citing Trump v. CASA. It wants the ruling overturned or limited to Epic only. The Supreme Court will consider the petition on June 25, with a decision expected by late June. Apple seeks to avoid court oversight on its fee structure, which could reshape app marketplace regulations.
