On May 4, District Judge Bryan Biedscheid will decide whether Meta contributed to a public nuisance and must fund state programs. DOJ lawyers seek mandatory age verification, predator removal, and safeguards against encrypted communications.

Meta’s unsealed defense argues the demands are broad and would force it to create separate apps for New Mexico residents, citing economic and engineering impracticality. The company also claims the state lacks authority, framing the move as a free‑speech challenge.

Attorney General Raúl Torrez dismissed Meta’s claims, insisting the platform can implement the changes and accusing the company of prioritizing revenue over child safety. The case underscores how state regulations can pressure tech giants to alter core platform features or face market exit.
