Judge Rejects Musk's OpenAI Source Code Demand in Apple Lawsuit

A U.S. magistrate judge denied Elon Musk's X and xAI their bid to force OpenAI to hand over its proprietary source code. The request came in their ongoing antitrust lawsuit against Apple and OpenAI, which claims the ChatGPT iOS integration unfairly blocks competing AI apps. The court found the demand irrelevant and disproportionate.

The judge criticized the case's excessive discovery disputes, noting over 135 docket entries in just five months. X and xAI sought the code to challenge OpenAI's claim that technical barriers prevent integrating Grok into Apple Intelligence. The court ruled plaintiffs failed to show why less intrusive methods couldn't address their claims.

This ruling deals another setback to Musk's aggressive legal strategy. Previously, South Korea's government also denied a similar, broad document request against Kakao. The lawsuit, filed in August 2025, continues, but the court's patience is clearly wearing thin with the plaintiffs' tactics.
