However, the shoe company didn't file its own trademark application until October 2023, which remains under review by the U.S. Patent and Trademark Office.

The case raises questions about trademark rights in different industries, as the restaurant operates in the bar and restaurant category while the sneaker company's application covers clothing. The plaintiffs allege that consumers have contacted 1587 Sneakers believing they are affiliated with 1587 Prime, though evidence supporting this claim has not been publicly provided. The sneaker company seeks to prevent the restaurant from using the name and selling merchandise with the branding.
