The Senate unanimously passed the DEFIANCE Act, empowering victims of nonconsensual sexually explicit deepfakes to sue creators and hosts. This civil action bill targets the proliferation of AI-generated abuse material, offering legal recourse for those whose likeness is weaponized without consent.

The urgency stems from X's Grok chatbot, which made creating deepfakes frighteningly simple. Users could reply to any post with @grok to generate explicit images, including those of children. This vulnerability prompted investigations from UK regulator Ofcom and outright bans in Malaysia and Indonesia.

Unlike previous regulations targeting platforms, the DEFIANCE Act focuses on holding individuals accountable. After stalling in the House last year, advocates hope this renewed legislative push succeeds. If passed, creating or hosting such content could result in severe financial liability for offenders, shifting the risk calculus for bad actors.
