A jury has ruled against Elon Musk in his lawsuit against Sam Altman and Greg Brockman, finding the OpenAI executives not liable. The panel determined the statute of limitations had already expired when Musk filed his 2024 case accusing them of "stealing a charity" after his 2018 departure from the AI lab. Judge Yvonne Gonzalez Rogers agreed with the verdict and dismissed the claims as untimely.

During three weeks of testimony, Musk's legal team tried to paint Altman as dishonest, even referencing his recent New Yorker profile. Altman struggled on the stand, hesitating when asked if he considered himself honest. Musk himself was absent for part of the trial—reportedly with Trump on a China diplomatic trip—despite the judge ordering him to remain available.

Musk had sought to undo OpenAI's for-profit conversion and force Altman and Brockman out of their positions. Judge Rogers signaled she would reject any appeal "on the spot," effectively ending his legal path in this case. His case hinged on overturning regulatory work that OpenAI had already completed with state attorneys general.
