Apple Asks Supreme Court to Intervene in Epic Games Battle

Apple has filed a formal request with the Supreme Court to review the ongoing legal battle with Epic Games. The tech giant argues that lower court rulings regarding anti-steering injunctions exceed established legal limits. This move follows a period of failed attempts by the company to delay proceedings in the lower courts.

Central to this petition is the claim that a contempt ruling was issued based on the spirit of the law rather than its literal text. Apple contends that applying these injunctions to all US developers ignores the precedent set by the CASA ruling. If the Supreme Court declines to act, the current injunction remains in place.

Winning this appeal would allow Apple to maintain its 12% and 27% commission rates even when developers link to external payment methods. Conversely, a loss for Apple means the broad injunction stays, potentially limiting its ability to collect fees from any developer in the United States. The court will consider the petition during its June 25 conference.
