Epic Opposes Apple’s Sealing Bid for Link-Out Fee Data

Epic Games has filed an opposition to Apple's request to seal key data regarding its proposed commission rates for purchases made outside the App Store via external links. Apple recently submitted a proposal outlining fees: 15% for standard apps, 10% for programs like the Video Partner Program and subscription renewals, and 5% for Small Business Program apps.

Alongside this proposal, Apple requested that portions of its expert reports be sealed, citing commercially sensitive financial data, link-out adoption estimates, and developer survey results. Epic argues these requests are overly broad and aim to "conceal information from the public," unnecessarily hampering legal proceedings. The company contends that Apple has failed to justify why such critical information should remain hidden from public view.

Epic highlights that courts have previously rejected sealing requests lacking specific harm examples. Furthermore, Epic asserts that some sought-after data is either outdated or already publicly available. A primary point of contention is Apple's attempt to redact statistics on how many apps have adopted external purchase links since the court’s contempt order. Epic maintains this adoption rate is not competitively sensitive and is vital to determining fair commission structures. The opposition details objections to more than 60 proposed redactions across Apple’s filings.
