Epic Opposes Apple's Request to Pause App Store Case

Epic has submitted its opposition to Apple’s request to pause lower-court proceedings regarding App Store commissions while the Supreme Court reviews whether Apple was properly held in civil contempt for violating a 2021 injunction.

Judge Yvonne Gonzalez Rogers previously ordered Apple to allow developers to direct users to outside payment options. While Apple complied by adding external links, it imposed a 27% commission and strict presentation restrictions, leading the judge to rule that Apple violated the injunction. Apple argues the Supreme Court's upcoming decision could reshape the legal basis for determining these commissions.

Epic contends this is Apple’s third attempt to delay competition, noting that the Supreme Court may not rule until as late as June 2027. Epic argues that determining an appropriate commission is a separate issue from the contempt ruling and should move forward now for efficiency.

If the court denies Apple’s motion, Apple must file its external-link commission proposal within 24 hours of the ruling. If granted, proceedings will remain on hold pending the Supreme Court's decision.
