Apple, Epic Clash Over Pausing App Store Case

Apple has responded to Epic Games' opposition regarding a request to pause lower-court proceedings while the Supreme Court reviews a portion of their App Store dispute. The Supreme Court agreed to examine whether Apple was properly held in civil contempt for charging commissions on purchases made outside the U.S. App Store, a finding stemming from a 2021 injunction.

Apple argues that pausing the proceedings is necessary because the Supreme Court's decision could significantly alter or eliminate the need for further lower-court work on commission charges. Epic, however, contends that Apple is using this as a delaying tactic and that proceedings will likely be similar regardless of the Supreme Court's ruling on contempt.

In its response, Apple asserts that Epic's arguments are based on incorrect assumptions and mischaracterize the scope and impact of the Supreme Court's review. Apple emphasizes that the contempt finding is the sole basis for any remand proceedings concerning commissions and that the Supreme Court's review could invalidate or reshape this finding. Apple also requests a stay from higher courts if the lower court denies its pause request.
