Trans Youth Sue DOJ Over Medical Record Subpoenas in Escalating Legal Battle

Transgender adolescents and their families are asking federal courts to block Justice Department subpoenas demanding medical records from major children's hospitals. The lawsuits challenge criminal subpoenas issued to NYU Langone and Stanford's Lucile Salter Packard Children's Hospital, arguing the government is violating constitutional privacy rights under false pretenses.

The Trump administration claims it is investigating off-label medication use and fraudulent billing practices related to gender-transition treatments for minors. However, families contend the inquiry aims to intimidate hospitals into ending care permitted under state law. At least seven federal judges have already partially or fully blocked similar subpoenas, finding improper political motivation.

Legal teams including Lambda Legal and the ACLU argue hospitals face "no meaningful discretion" when served with criminal subpoenas. Some providers have already complied with government demands. The standoff affects dozens of hospitals including Yale New Haven Health and Connecticut Children's Medical Center, many of which have suspended transgender care programs citing federal pressure.

Major medical societies endorse gender-transition treatments for minors experiencing significant distress. With approximately 724,000 transgender youth aged 13-17 nationwide, the legal outcome will determine whether healthcare providers can refuse federal demands for sensitive patient information. Courts must balance investigative authority against fundamental privacy protections.
