Judge Blocks Trump Plan to Strip Yemenis of Temporary Protection

Federal Judge Dale E. Ho in Manhattan halted the Trump administration’s plan to strip Temporary Protected Status from Yemeni migrants. The ruling, issued Friday, preserves legal residence and work authorization for those vetted under the program, which safeguards citizens fleeing Yemen’s ongoing armed conflict until the administration completes its mandated review, giving the affected population a temporary legal shield.

The decision follows lawsuits by the Asian American Legal Defense and Education Fund and the Center for Constitutional Rights, which argued that Yemen’s removal from Temporary Protected Status violated the Administrative Procedure Act. Plaintiffs, seven Yemeni nationals, contend that the agency failed to consult key departments before revoking protections and that such action endangers thousands of vulnerable migrants.

Officials defended the revocation by citing T.P.S.'s temporary nature and national security priorities. Critics noted that the program, established in 2015, allows displaced people to work and live in the U.S. without risking detention or deportation, a safeguard that the court now keeps intact until a full review is finished, providing legal certainty for over 3,000 residents.

The ruling underscores the judiciary’s role in checking executive actions that affect migrant protections. With the Supreme Court set to decide similar cases for Haitians and Syrians, the outcome could set precedents for future Temporary Protected Status challenges, influencing how the Department of Homeland Security navigates humanitarian crises and shaping policy for millions of displaced individuals.
