The tariffs, justified under the 1977 International Emergency Economic Powers Act (IEEPA), have faced skepticism from justices during hearings. Markets are pricing in a likely ruling against the administration, with Polymarket showing a 36% chance the White House prevails. U.S. Trade Representative Jamieson Greer stated that new duties would be prepared "the next day" if the tariffs are struck down.

This legal uncertainty hangs over Trump's use of tariffs as a primary tool in international negotiations, most recently with his demand for U.S. ownership of Greenland. European leaders have decried the tactic as blackmail and are reportedly considering responses, including an anti-coercion instrument to limit U.S. access to the EU market.
