The Department of Commerce has issued a National Security Determination identifying foreign-produced robotic devices as posing significant risks to U.S. critical infrastructure. The determination, published in the Federal Register, specifically targets connected robotic systems manufactured in China and Russia that could enable surveillance, data exfiltration, or operational disruption.

The rule establishes a review framework for Information and Communications Technology and Services (ICTS) transactions involving robotic platforms with sensing, processing, and network connectivity capabilities. Covered systems include industrial robots, autonomous vehicles, drones, and medical devices that integrate with U.S. networks.

Commerce Secretary Gina Raimondo emphasized that the determination addresses "unacceptable risks" from adversarial nations exploiting hardware and software supply chains. The order requires entities to submit detailed risk assessments for covered transactions within 30 days, with potential mitigation measures including procurement bans, mandatory audits, or forced divestiture.

Industry groups representing robotics manufacturers and critical infrastructure operators have requested clarification on compliance timelines and scope definitions. The determination follows Executive Order 13873 and aligns with broader efforts to secure the ICTS supply chain against foreign adversary exploitation.
