A Broward County judge has dismissed a red-light camera ticket, ruling Florida's automated traffic enforcement law unconstitutional. Judge Steven P. DeLuca found that the statute improperly shifts the burden of proof onto vehicle owners, violating due process protections.

In a 21-page order, the court determined that red-light camera cases function as 'quasi-criminal' proceedings despite being labeled as civil infractions. The ruling challenges Florida Statute 316.0083, which presumes registered owners are responsible unless they identify another driver. Attorney Joel Mumford explained that in quasi-criminal cases, the state must prove 'beyond and to the extent of each and every reasonable doubt' who was driving.

Legal experts say the decision could spark broader challenges to Florida's red-light camera enforcement system. While currently limited to Broward County, the ruling might influence appellate courts if appealed. Drivers in Boynton Beach expressed frustration with the cameras, with one paying a $158 ticket calling the system 'ridiculous' and hoping Palm Beach County follows suit. Advocacy group StopTheCams called the decision a major victory, arguing automated enforcement punishes owners without requiring proof of their involvement.
