Florida Woman Ticketed Despite No Right Hand Sparks Distracted Driving Debate

A Lake Worth Beach, Florida woman with no right hand was cited for holding a phone in her 'right hand' during a February 11 traffic stop. The Palm Beach County Sheriff's Office deputy claimed to have seen the device in her right hand while she traveled northbound on North Dixie Highway. The citation, which carries a $116 civil penalty under Florida Statute 316.305(3)(a), quickly went viral after she posted the encounter on TikTok.

Legal experts say the ticket likely wouldn't hold up regardless of her physical condition. Florida law only prohibits manually typing or entering data into devices outside school and work zones, and neither box was checked on her citation. Attorney Ted Hollander of the Ticket Clinic told CBS12 that holding a phone while driving remains legal in most areas of the state. The woman has requested body camera footage and plans to fight the citation in court.

This case highlights how drivers often pay questionable tickets without challenge. Hollander noted that texting-while-driving citations are rare in Palm Beach County because they're difficult for officers to prove. The incident serves as a reminder that drivers should understand their rights and the specific provisions of distracted driving laws before simply accepting citations.
