The lawsuit argues that Visa and Mastercard, along with the bank defendants, have maintained a web of anticompetitive rules that prevent merchants from steering customers to lower-cost payment options and eliminate incentives for issuing banks to compete on fees. As a result, merchants now pay over $100 billion annually in fees to accept Visa and Mastercard credit cards.

The suit notes that a prior $5 billion class action settlement approved in December 2019 only covered fees through January 24, 2019, leaving merchants without compensation for fees paid since January 25, 2019. The new lawsuit seeks to represent all U.S. merchants that accepted Visa or Mastercard credit cards from that date onward, aiming to address ongoing injuries from the alleged anticompetitive conduct.
