West Virginia Sues Apple Over iCloud CSAM Claims

West Virginia Attorney General JB McCuskey has filed a lawsuit against Apple, accusing the company of knowingly allowing iCloud to be used for distributing child sexual abuse material (CSAM). The lawsuit alleges that Apple has "done nothing about it" for years despite having the technical capability to detect and report such content through its control over hardware, software, and cloud infrastructure.

The suit claims Apple internally described itself as the "greatest platform for distributing child porn" while submitting far fewer CSAM reports than competitors like Google and Meta. McCuskey argues that Apple's decision to abandon CSAM detection technology in 2022 was a deliberate choice rather than passive oversight, and that the company has shirked its responsibility to protect children under the guise of user privacy.

This legal action follows a similar 2024 lawsuit representing 2,680 victims seeking $1.2 billion in damages. Apple has maintained that scanning private iCloud data would create security vulnerabilities and that child protection can be achieved without companies combing through personal data. The West Virginia lawsuit seeks both punitive damages and injunctive relief requiring Apple to implement effective CSAM detection measures.
