Blackburn Unveils Draft Federal AI Bill Targeting Safety, Copyright, and Section 230

Senator Marsha Blackburn (R-Tenn.) has introduced the first draft of a federal AI bill, aiming to codify President Trump's December executive order. Her stated goal is a policy that 'protects children, creators, conservatives and communities from harm.' The discussion draft places a duty of care on AI developers to prevent foreseeable harm and explicitly states that using copyrighted works for AI training doesn't qualify as fair use. It mandates safeguards for users under 17, protects against unauthorized digital replicas, and sets guidelines for detecting AI-generated content.

Crucially, it seeks to end Section 230, a move critics argue could make AI companies liable for harmful content, though this faces significant negotiation. While some provisions appear positive to critics, the bill also includes a Republican complaint about combating bias against conservatives through third-party audits.
