Senate Democrats are confronting judicial nominees over their refusal to acknowledge Joe Biden's 2020 election victory. During confirmation hearings, Senator Richard Blumenthal has repeatedly asked nominees whether Biden won the popular vote, only to receive evasive answers about Biden being "certified" or having "served" as president.

According to the New York Times, 37 of Trump's judicial nominees have given similar non-answers, avoiding direct acknowledgment of Biden's victory. The White House appears to be coordinating this messaging, with nominees like Andrew Davis telling Blumenthal that Biden was merely "certified" president despite serving a full four-year term.

The pattern extends beyond judicial confirmations. Homeland Security nominee Markwayne Mullin also refused to acknowledge Biden's 2020 win during his hearing. Legal experts suggest this represents a shift from Trump's first term, when the Federalist Society essentially selected nominees based on ideology rather than personal loyalty.
