Twelve former federal prosecutors who worked on January 6th cases have sent a letter to the Senate urging them to stop confirming judicial nominees who refuse to acknowledge the reality of the 2020 election results.

The letter, released at a press event with Democratic Judiciary panel members, highlights a troubling trend in judicial confirmations where nominees, particularly those from Trump's second term, have avoided stating that Joe Biden legitimately won the 2020 election. These nominees also typically evade questions about January 6th, condemning violence generally but refusing to characterize the specific events of that day.

Former assistant U.S. attorney Sean Murphy stated, "Please stop poisoning our courts by confirming appointees who refuse to admit basic historical truths. This is not a problem of perspective or political persuasion. It is a fundamental question of competence." He added that such nominees have lost credibility and traded a piece of their soul for a lifetime appointment.

Nominees have reportedly been coached to evade questions, often stating Biden was "certified by Congress" or "served" as president, rather than simply acknowledging his victory. This scripted uniformity suggests loyalty to Trump's lies is a prerequisite for nomination, with the Senate, including some Democratic senators, confirming them regardless. Murphy frames this evasion as a fundamental question of competence, arguing that a judge unwilling to state documented historical facts on the record has revealed how they might rule in critical cases.
