Metro Loft Developer Faces Lawsuits Over Construction Defects

Nathan Berman's Metro Loft faces mounting legal pressure as two lawsuits allege systemic construction failures across multiple Manhattan properties. The Tribeca condo board's complaint details "defective and unsafe conditions" in a 130-year-old factory conversion renovated over a decade ago, with an architect labeling some defects life-threatening. The board claims Metro Loft collected millions of dollars despite code violations spanning roof, walls, ventilation, and plumbing. Celebrities including Justin Timberlake and Jessica Biel previously resided in the building.

A separate 2023 suit from a construction firm seeks $200,000 in unpaid invoices for work at 87th Street and East End Avenue. Metro Loft disputes both claims in court filings. The scrutiny intensified this week after Berman's East Side high-rise triggered stability concerns and evacuations. The project's general contractor, 235 GC LLC, accumulated seven Department of Buildings violations last year — including falling metal and glass and a worker falling from a ladder — all now marked resolved.

Berman acknowledged potential "human error" on the East Side project but declined to address the Tribeca allegations. The pattern of violations and unpaid contractors suggests operational strain that could complicate financing for future developments and invite deeper regulatory scrutiny of Metro Loft's portfolio.
