However, she highlighted instances where the court has "checked the executive branch" and ruled against the Trump administration on significant issues, such as rejecting certain tariffs and efforts to end birthright citizenship.

Kagan's remarks come amid declining public trust in the Supreme Court, with critics suggesting political motivations among justices. She defended the court against perceptions of being a "puppet for the current administration." Kagan also reiterated her support for appointing a committee of retired judges to enforce the court's first code of ethics, adopted in 2023 amid criticism over undisclosed gifts and trips.

She also recounted President Trump's attendance at oral arguments for a birthright citizenship case, describing it as a "non-event" for the justices and suggesting he might not return due to the lack of ceremony.
