This legal battle stems from an antisemitism investigation led by the Equal Employment Opportunity Commission. The government sought names and contact details for individuals in Jewish studies programs or related campus organizations. Penn fought the subpoena, arguing that the request violated First Amendment rights and privacy protections.

While Judge Pappert previously dismissed Penn's comparisons of the inquiry to Nazi-era tactics, he granted the stay to ensure an orderly appellate process. The university maintains it lacks formal lists of employees by religion, though it must provide whatever existing records it possesses. The case now rests with the Third Circuit.
