Fox News Wins Dismissal of Reporter's Lawsuit

A federal judge has dismissed a lawsuit against Fox News by former reporter Jason Donner, who claimed he was fired for raising concerns about the network's coverage of the 2020 election and January 6 Capitol riot. Donner, a 12-year employee, alleged retaliation and discrimination after repeatedly questioning the network's amplification of false election claims.

Judge Amir H. Ali granted summary judgment in favor of Fox, finding Donner failed to notify his manager promptly about his sick leave before being terminated in September 2022. Another judge had already dismissed related claims in April 2024, ruling that Donner couldn't prove discrimination based on political affiliation for not aligning with President Trump's positions.

Judge Christopher R. Cooper wrote that a journalist's termination for insisting on truthful reporting doesn't constitute an actionable employment claim in Washington D.C. The rulings effectively end Donner's legal challenge against the network. Lawyers for Donner didn't respond to requests for comment, and Fox News declined to provide additional statements. The decisions underscore the difficulty of pursuing employment claims based on ideological disagreements with employer coverage decisions.
