Central California farmer Cesar Mora is distributing thousands of pounds of nectarines for free instead of letting them spoil. He’s caught in a legal battle with Giumarra Brothers Fruit Co. over exclusive rights to the "Monalise" white nectarine variety he cultivates. This situation highlights the growing conflict between independent growers and entities controlling patented plant breeds.

Mora claims Giumarra misled him into a contract for the "Monalise" variety, later alleging Giumarra mishandled his crop and violated marketing agreements. The dispute escalated when Mora sought to end the contract and sell to another packer, prompting Giumarra’s breach of contract lawsuit. Giumarra maintains the agreements are valid regardless of plant patent status, while Mora faces significant income loss.

Mora has already given away over 100,000 pounds of nectarines, with community members assisting in the distribution. The legal fight, which has impacted a quarter of his income, underscores the challenges third-generation farmers face with increasingly common fruit patents and licensing agreements. Giumarra, meanwhile, insists the legal process will resolve the facts of the case.
