Judge Mark Pittman today rejected Open AI's request to obtain X and Space XAI's confidential settlement agreement with Apple in their ongoing antitrust case. X and Space XAI informed the federal court that after reaching an agreement with Apple, they would move to dismiss their claims against the iPhone maker. In the lawsuit, Elon Musk's companies accused Apple and Open AI of colluding to shut competing AI apps out of the market, including by preventing them from gaining visibility on the App Store.

Open AI filed an emergency motion asking the judge to compel production of the agreement's terms, arguing they could contain information relevant to its defense. After reviewing the agreement in camera, Judge Pittman found it does not present information relevant to the issues at hand. The Court hesitates to compel production of confidential settlement agreements, noting they are not relevant to the remaining case against Open AI.
