Attorneys Elliot Sol Abrams and Tony Clayton argued the NCAA arbitrarily distinguishes between American players who sign pro contracts and international players from overseas professional leagues who retain eligibility. They noted Luis never played for the Celtics' G League team due to injury and has a lesser professional résumé than many current college players recruited from abroad.

NCAA attorney Taylor Askew countered that Luis chose to leave college for the NBA, citing Alabama's Charles Bediako as the only comparable case; Bediako won a temporary restraining order but ultimately lost his eligibility case. The decision could establish a precedent for players with professional contracts seeking to return to college basketball amid the NCAA's new revenue-sharing model.
