Ted Cruz Bill Would Ban NDAs in Child Abuse Cases

U.S. Senator Ted Cruz has introduced bipartisan legislation that would void and prohibit confidentiality clauses in child sexual abuse cases. The Terminating Restrictive Enforcement of Youth Settlements (TREY'S Law) makes any non-disclosure agreement unenforceable if it restricts disclosure of sexual abuse of a minor, regardless of when the NDA was signed.

Named after Trey Carlock, who committed suicide at 28 after being forced into settlements with restrictive NDAs following sexual abuse by a Kanakuk Ministries director, the bill is co-sponsored by Senator Kirsten Gillibrand and other Republican senators. Carlock's case gained national attention after a 2009 criminal investigation revealed the extent of the abuse and subsequent cover-ups.

Texas has already enacted its version of TREY'S Law, with other states including Missouri, Tennessee, California, and Alabama passing similar legislation. The bill has garnered support from major advocacy groups including RAINN and the National Coalition to Prevent Child Sexual Abuse and Exploitation. If passed, the legislation would allow survivors to speak freely about their experiences and hold perpetrators accountable without fear of legal repercussions from existing NDAs.
