Penn State Sued Over DEI Promotion Requirements

A Penn State Extension educator has sued the university, claiming she was twice denied promotion because she failed to sufficiently advance the institution's diversity, equity and inclusion agenda. Molly Kelly alleges the promotion committee questioned her DEI activities, saying they merely "checked the box" rather than demonstrating genuine ideological alignment with the university's diversity initiatives.

Kelly's attorney argues that public universities cannot condition employment decisions on parroting preferred viewpoints, claiming DEI requirements operate as "tools of coercion." The lawsuit, which names Penn State Extension, President Neeli Bendapudi and the Extension director as defendants, seeks to prohibit the university from using DEI criteria as a promotion condition, citing violations of the First and 14th Amendments.

The lawsuit details how Kelly's first promotion application was denied because she showed "no evidence of efforts to reach underserved audiences" and only met "minimum diversity training hours." Her second application was rejected when the committee questioned whether technical assistance to LGBTQ and Greek Orthodox-owned businesses qualified as diversity training, calling it "thought-policing, not professional evaluation."

Kelly, who has worked for the university since February 2018, seeks to restore what she calls the "freedom of thought" in public universities. Penn State declined to comment on the pending litigation, maintaining policy to not discuss ongoing legal matters. The case represents a growing challenge to DEI requirements in higher education institutions nationwide.
