The EEOC had sued The Times in May, alleging the newspaper discriminated against a white male employee, Bryant Rousseau, by passing him over for a promotion in favor of a multiracial woman. The agency sought to bar the company from using diversity, equity, and inclusion (DEI) policies and sought unspecified damages.

The Times, in its filing, asserts the EEOC deviated from its standard practices to pursue the case, particularly after The Times published reporting critical of the agency. The newspaper claims the EEOC omitted details from its eight-month investigation, including offers of two other positions to Rousseau that aligned with his career goals. The Times’ legal team argues the selected candidate for the deputy real estate editor role possessed superior experience in service journalism and a clearer vision for future coverage.

This legal battle raises questions about the scope of DEI initiatives and the potential for government agencies to retaliate against media organizations critical of their operations. The Times is seeking a court order to halt the EEOC's lawsuit, citing First Amendment violations. Notably, an EEOC commissioner, Kalpana Kotagal, publicly stated she voted against the lawsuit, expressing concern it was driven by political agenda rather than merits.
