Cloudflare vs Italy Piracy Shield: Internet Freedom at Risk

Cloudflare is challenging a €14.2 million fine from Italy's regulator AGCOM for refusing to implement DNS blocking via its 1.1.1.1 resolver. This dispute centers on the 'Piracy Shield' system, designed to block illegal sports streaming. While intended to protect Serie A football rights, the system imposes blocks within 30 minutes without judicial oversight, leading to significant collateral damage.

The technical reality of shared infrastructure means blocking IP addresses often shuts down legitimate services, including Google Drive and YouTube. Matthew Prince, Cloudflare's CEO, argues that transforming neutral infrastructure into a content moderator creates a dangerous precedent for global internet fragmentation. The EU Commission has raised concerns that the system violates the Digital Services Act and fundamental rights. AGCOM Commissioner Elisa Giomi even expressed fears of unintentional censorship. If Cloudflare capitulates, it risks fragmenting the internet into a 'Splinternet,' forcing providers worldwide to enforce local censorship.
