Judge Dismisses Criminal Charges Against Deported Immigrant Abrego Garcia

A federal judge in Nashville dismissed human smuggling charges against Kilmar Abrego Garcia, ruling that the Justice Department pursued prosecution to punish him for challenging his mistaken deportation to El Salvador. U.S. District Judge Waverly Crenshaw found the case reflected 'an abuse of prosecuting power' and showed presumptive vindictiveness.

Abrego Garcia was deported in 2024 despite a 2019 immigration court order protecting him from return to El Salvador due to gang threats against his family. The smuggling charges stemmed from a 2022 Tennessee traffic stop where he received only a warning. Prosecutors reopened the case after the Supreme Court ordered his return to the U.S., timing that Crenshaw cited as central to the vindictiveness finding.

The Trump administration had publicly touted the charges, with then-Attorney General Pam Bondi declaring 'This is what American justice looks like.' The Justice Department called the ruling 'wrong and dangerous' and vowed to appeal.

Despite the criminal case dismissal, Abrego Garcia's future remains uncertain. Barred from deportation to El Salvador, officials have threatened to send him to African nations including Liberia, though his family continues fighting for his right to remain in the U.S. with his American wife and child.
