The Graphene OS Foundation is defending its ultra-secure Android-based operating system after an activist, Sam Tunick, used its data-wiping function to block federal agents from searching his phone. Tunick, an environmental activist, was indicted in November for allegedly violating a US law against destroying government property.

In January 2025, US Customs agents demanded Tunick's phone password at the airport. He provided a "duress password" that irreversibly wipes the device. The Graphene OS Foundation stated that the software is legal and its security protections will not be weakened. They explained that features like the "auto-reboot timer" are designed to prevent data extraction, though they cautioned users about the consequences of using the duress password in real-world situations.

The foundation confirmed that data recovery or bypassing encryption is impossible after the key material is wiped, emphasizing the hardware and software's design to prevent such actions. This case highlights the ongoing debate between privacy and US investigatory powers, echoing past disputes with companies like Apple over encryption. Tunick faces up to five years in prison if found guilty.
